GENERAL TERMS AND CONDITIONS FOR RIDE ON
1. General
Unless otherwise expressly agreed, these terms and conditions shall apply to all transactions between the guides of Ride oN and their customers. As self-employed individuals, the guides provide instruction in the skills and knowledge of mountain biking as well as guiding and accompanying guests on mountain biking tours.
2. Contract and pricing
Reservations for private lessons can be made by telephone or email. These will be considered firm bookings once confirmed in writing by Ride oN. The offers made by Ride oN are subject to change. Its written confirmation is the sole notice that your reservation and the services booked have been accepted. Any agreements made verbally, either in person or by telephone, are only valid if confirmed expressly in writing by Ride oN. All prices quoted by Ride oN are in euros and, unless otherwise noted, include all statutory charges and taxes. Price lists are subject to change. No liability is accepted for misprints.
3. Payment terms
Unless otherwise agreed in writing, a down payment of 20% of the total is due immediately after written confirmation of online or telephone reservations is sent. The remainder is due upon completion of the services booked. For reservations made in person, the fee is to be paid directly in full to Ride oN.
4. General terms and conditions of participation
Parties hiring Ride oN’s services must provide truthful and comprehensive information about their skills and experience in mountain biking. They are also responsible for providing gear that meets the current state of the art and other external conditions. They must also provide Ride oN a clear representation of their physical abilities, especially their health and any ailments. Before courses and/or tours, they are responsible for having their own equipment checked by a specialist shop. Failure to do entitles Ride oN to cancel the reservation.
5. Liability
The guides of Ride oN accept liability under the statutory provisions only for damage directly related to his activity caused intentionally or through gross negligence. They carry the corresponding liability insurance.
6. Insurance
The participants are responsible for their own insurance. Accident and repatriation insurance is recommended.
7. Warranty
Participants must make any complaints about the services rendered without delay, either in person or by telephone in order to obtain remedy. A culpable failure to do so eliminates any claim to reduced fees. Claims against the guides of Ride oN must be made in writing no later than 2 weeks after the event, stating the grounds for said claims.
8. Rescission
Private bookings may be cancelled up to 45 days in advance of the scheduled date without paying a cancellation fee. If they are cancelled in less than 45 days prior to the scheduled date, Ride oN is entitled to retain the down payment. Refunds of payments already made for private bookings only in case of an accident or illness certified by a local doctor. The amount to be refunded will be recalculated based on the actual services already provided. Once the service begins to be offered or if the participants fail to show up, there will be no refunds. If weather conditions are such that the service might not be offered for safety reasons, Ride oN’s guides reserve the right to postpone or cancel the services booked. In this case, Ride oN is only obliged to repay what has already been paid; participants have no further right to damages.

9. Jurisdiction
Italian law applies exclusively to all disputes irrespective of the nationality of the parties to this contract or where the event establishing the claim occurred. The place of jurisdiction is Bolzano.
10. Severability
Should any of these terms and conditions be wholly or partially invalid, this shall not affect the validity of the remaining provisions. The invalid clause shall be replaced by a legally admissible provision that comes economically closest to the ineffective clause.
